Do You Have Other Claims?

Beyond Workers' Compensation Claims

Attorneys Peter Hansen and Evohl Malagon have more than 70 years of combined experience handling Oregon workers' compensation claims. This is the primary focus of our law firm. Our sophisticated understanding of the law provides a distinct advantage in protecting your rights and maximizing your recovery.

In particular, other attorneys who only dabble in this field may not be aware of additional claims arising from a work-related injury. At the Law Offices of Hansen Malagon, we always explore the possibility of additional claims above and beyond your employer-paid benefits.

Do You Have Additional Claims?

The trade-off of the workers' compensation system is that you cannot sue your employer for a job-related injury or illness. However, the Oregon Supreme Court has ruled that workers can bring lawsuits for employer negligence in cases where your claim was denied because the work injury or exposure was not the major cause of your injury or illness and the employer was negligent in causing your injury or illness.

There may also be personal injury negligence claims against third parties who are not in your line of employment:

  • Manufacturers of defective equipment
  • Other subcontractors on the same job site
  • Property owners or property management companies
  • An auto driver who crashed into you while you were on duty
  • Other parties who contributed to your on-the-job injury

In a direct lawsuit, you can seek damages not covered by workers' compensation: past and future actual lost earnings, past and future pain and suffering and lost enjoyment of life.

Call us at 503-821-7934 or 866-661-8679 for a free initial consultation. We will pursue all entitled benefits through workers' compensation and determine if you have additional claims. We can meet clients at locations in Portland, Gresham/Clackamas, Salem or Eugene/Springfield, with flexible appointments, or we can come to you if you are seriously injured.

As with workers' comp claims, we collect no attorney fees for third party or at-fault employer claims unless we recover compensation.
